Section B
Minar Jewellers. Terms and Conditions for sale of gold bullion
18 - Placing an order for gold bullion
18.1 Online Bullion Orders can be placed through the website only. Once you have placed an order cancellation is not possible under the distance selling regulations due to the fluctuating nature of the precious metals market. We will pursue payment for all orders placed.
18.2 After an order has been placed via the website, you will receive an automated email from us acknowledging that we have received your order ('Order Confirmation'). However this does not mean that your order has been accepted.
18.3 Your order constitutes an offer by you to us to buy a product. We will confirm acceptance of your order by sending you further correspondence that confirms that the Product has been or shall be shortly dispatched (the ‘Shipping Confirmation'). The contract between us ('Contract') will only be formed when we send you the ‘Shipping Confirmation’, not when we send you the 'Order Confirmation'.
18.4 Prices stated on the website will be fixed daily. The prices are based on the current trading price of gold. We reserve the right to cancel any order even after payment received. As we cancel an invoice, a full refund would be issued.
19 - Delivery of gold bullion
19.1 When ordering products for delivery outside of the EU, you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by the Customer. The Supplier has no control over these charges. Customs policies vary widely from country to country, so you should contact your local customs office for further information. Additionally, please note that when ordering you are considered the importer of record and must comply with all laws and regulations of the country in which the products are to be received. Customers’ privacy is important: international customers should be aware that cross-border deliveries are subject to opening and inspection by customs authorities.
19.2 We cannot be held responsible for delays in delivery or collection as a result of stock shortages, due to adverse weather, traffic delays, mechanical breakdowns or other circumstances beyond our control. Any dates quoted for delivery are approximate only and the time of delivery will not be of the essence of the contract.
19.3 All orders will be deemed delivered when signed for by any person at the delivery address or confirmed as delivered by our couriers. You must satisfy yourself before requesting any delivery that this will be secure as any loss incurred after the delivery is signed for at the address or confirmed as delivered by our courier will be your liability. This may particularly be a risk for you if you live in a house of multiple occupation or you choose delivery to a work address.
19.3.1 You should not accept or sign for any delivery where the package has been damaged, resealed or tampered with and instruct the courier to return the item to us. We cannot accept any liability for loss once any person at the delivery address has accepted a package.
20 - Returns of gold bullion
20.1 We will only accept a product being returned to us because you claim that the Product is defective. We will examine the returned Product. If we agree that the Product is defective we will replace the item immediately. If this is not possible because we do not have an acceptable replacement in stock, we will give you a refund within a reasonable period of time. Products returned by you because of a defect will be refunded in full including all delivery charges. Whilst we will usually refund any money received from you using the same method originally used by you to pay for your purchase.
